These Terms of Business provide general information about how Capital Advice delivers mortgage services, the regulatory framework that applies and the responsibilities involved when you ask us to advise on or arrange a mortgage.

Purpose and Status of These Terms
This website page is intended to give you a clear overview of the basis on which Capital Advice provides mortgage services. Before regulated mortgage advice or arranging activity is carried out, you will be given the disclosures and information required for the service relevant to you.
Where a separate disclosure document, service agreement, mortgage illustration, European Standardised Information Sheet or other transaction-specific document is provided to you, that document should be read carefully because it contains information specific to your circumstances and the service or mortgage being considered.
If there is any difference between this general website summary and a formal client-specific disclosure or agreement issued to you, the formal document relevant to your transaction will take priority for that matter.
Our Role
Orchard Financial Solutions Ltd is a brokerage and not a lender. The FCA does not regulate some investment mortgage contracts.
A lender makes the final decision on whether to accept an application and on the terms on which it is prepared to lend.

Product Range, Direct Deals and Alternative Finance
Before advisory services are provided, you will be told whether there are any limitations in the range of mortgage products that will be considered for you and, where relevant, what those limitations are.
You will also be told where relevant whether mortgage products available directly from lenders but not through an intermediary are outside the scope of the service being provided.
Where required, information will also be provided about the availability of alternative finance options so that the scope of the mortgage service is clear.
Why We Do Not Describe the Service as “Whole of Market” Here
The exact product range relevant to the service must be described accurately in the disclosure provided to you. This website therefore does not make a broader product-range claim that may not apply to every mortgage market or circumstance.
Fees, Remuneration and Commission
The basis on which the firm will be remunerated for the mortgage service will be disclosed to you before the relevant advisory service is provided.
If a fee is payable by you, the applicable amount or basis of calculation, when it becomes payable and any relevant terms will be explained in the client-specific disclosure or agreement before you become liable for that fee.
Where commission is received from a mortgage lender, the disclosures required for the mortgage and intermediary service will be provided. For mortgage credit intermediary services where the applicable rules require it, you may also have the right to request information about variations in commission payable by lenders whose mortgage products are being offered to you.
No Unconfirmed Fee Claim
This website does not describe the mortgage service as free or state a fixed adviser fee because the applicable remuneration and fee position must match the service and disclosure provided for your case.

Understand Your Circumstances
Relevant information is gathered about your needs, financial position, property plans and objectives.
Assess the Relevant Options
The mortgage options and lender criteria within the scope of the service are considered against the information provided.
Explain the Recommendation
Where advice is provided, the recommended route and important features, costs, risks and considerations are explained.
Support the Application
If you decide to proceed, Capital Advice can assist with the mortgage application and relevant communications as the transaction progresses.
A recommendation is based on your circumstances at the time of the advice and any reasonably foreseeable changes that are relevant and known during that assessment.
Your Responsibilities
Mortgage Availability Is Not Guaranteed
A recommendation or application does not guarantee that a lender will approve a mortgage. Lenders apply their own underwriting, affordability, valuation and lending criteria, which can change.
Documents, Product Information and Changes
Mortgage products, rates, fees, criteria and availability can change. Information discussed early in the process may therefore be different by the time an application or offer is produced.
Where applicable, you will receive mortgage-specific documentation setting out the product features, costs and other information required before you enter into the mortgage.
Where statutory cancellation or withdrawal rights apply to a service or agreement, the relevant rights and applicable process will be explained in the documentation provided to you.
Information From Other Professionals
Mortgage advice does not replace specialist legal, tax, accountancy, surveying or other professional advice where those matters are relevant to your plans. You should obtain appropriate specialist advice where necessary.
Complaints
If you are dissatisfied with the service you receive, please tell us so the matter can be reviewed. Details of how to raise a complaint and, where applicable, how an eligible complaint may be referred to the Financial Ombudsman Service are set out in our Complaints Procedure.
Privacy and Personal Information
Personal information is processed in accordance with applicable data protection requirements. Our Privacy Policy explains how information is collected, used, shared and retained and the rights that may apply.
